ARBITRATION 

We are the leading practice in the arbitration space - engaged in all major arbitration matters presently on-going in Maldives. Our experts have acted as counsel and local counsel in a wide range of proceedings, including those under the ICC, ISCID, UNCITRAL, LCIA, SIAC, DIAC and MIAC rules. 

Our managing partner is the chairman of MIAC and our senior consultant is the vice chairman of MIAC. 

Recent Matters  

  • We successfully obtained recognition and enforcement of an arbitral award rendered in a foreign seated arbitration for the first time in Maldives. We obtained the enforcement in record time and assisted with collecting the award sums from the local party.
  • We acted as local counsel for a fortune 500 hotelier in successfully obtaining a multi-million-dollar award in damages against a local owner.
  • We successfully ousted parallel proceedings begun by a local owner against a hotelier which had obtained an award from a foreign seated arbitration. In this regard, we acted as counsel which had obtained the first judgment which barred re-mitigating matters which were subject to foreign seated arbitration and had obtained the leading Supreme Court judgment in the matter which largely accepted all the positions maintained in our pleadings.

MEDIATION

Our firm provides has a particular focus on mediation - front loading settlement attempts in order to avoid litigation costs and built strategies to avoid subsequent disputes. Our lawyers give pragmatic solutions for swift achievement of client objectives in mediations. Our service is always bespoke, and we build in remediation efforts following outcomes from each mediation.

Recent Matters 

  • We successfully obtained a very favourable settlement on behalf Maldives’ largest airport operator in relation to claims brought by globally present infrastructure contractor. 

LITIGATION 

We have unmatched success rates in our litigation practice. The key to this is no secret, we are clear in our advice at the outset of our clients prospects of success on any contentious matter and only take forward to matters court in which we feel that our clients have a reasonably good prospect in achieving the desired outcome. 

Recent Matters 

  • Won a multi-million dollar arbitration award in damages for a world leading hotel operator and successfully obtained recognition of the award’s legality, validity, and enforceability of arbitration agreements and foreign arbitral awards in the Maldives. 
  • Successfully negotiated a substantial favorable settlement for a construction contractor through which our client avoided litigation with a state-owned development corporation.
  • Prevailed in an action for largest cable TV operator in the Maldives against the local tax authority. In this landmark decision, which is now the leading authority on this point, the Supreme Court of the Maldives agreed with our submissions with respect to the interpretation and application of the Business Profit Tax Act.
  • Successfully acted for one of the most profitable hotel operators in Maldives in which the court agreed with our submissions and limited the scope of the Business Profit Tax Act such that withholding tax is not charged to reimbursement expenses under hotel management agreements unless the nature of specific transactions are same as those specified in the Act.
  • Obtained a landmark employment decision in favor the largest hotel management conglomerate in Maldives. The Supreme Court agreed with our submissions, and this is now the leading authority in Maldives on redundancies.
